"procurementMethodRationale": "The award of this contract without prior publication is lawful as the procurement falls outside the scope of the Public Contracts (Scotland) Regulations 2015 and therefore outside the application of the Directive.\r\n Caledonia Housing Association, in partnership with The Highland Council, is delivering new affordable homes in the Highland area. The development is situated on land owned by the Developer, Springfield Properties PLC. Under the terms of the Section 75 planning agreement attached to the site, and the associated land purchase arrangement, the design and build works forming this contract must be undertaken by Springfield Properties PLC as a condition of the land transfer. Caledonia is therefore unable to invite competition or appoint another contractor for these works.\r\n Because the contract is intrinsically linked to the land transaction and is conditional upon the works being delivered by the landowner, the procurement does not constitute a freely tenderable public works contract in the open market. The circumstances do not allow for competition, as no alternative operator has legal rights to develop the site, access the land, or fulfil the planning obligations applied by the Local Planning Authority. The nature of the agreement places the works outside the normal scope of the Directive.\r\n As a result, publication of a Contract Notice or procurement through a competitive route is neither feasible nor applicable. Caledonia Housing Association has lawfully awarded the contract without prior publication, in accordance with the relevant exemptions and in compliance with public procurement requirements.",
