    "procurementMethodRationale": "CMAL has a requirement for a Commercial Cost Advisor (Phase 1) and NEC4 Project Manager (Phase 2 -subject to funding) to administer an NEC4 construction contract for the re-development of the harbour at Port Ellen, Islay. CMAL intend to make an award from Lot 9 of the Scotland Excel Framework Agreement for Technical Consultancy Ref 0820. This framework is let under the Public Contracts (Scotland) Regulations 2015, as per section 9.1.2 of the Scotland Excel General Conditions of Contract for Services.\r\n CMAL is defined as a Utility under Regulation 12 of The Utilities Contracts (Scotland) Regulations 2016, meaning a possible technical breach of the Regulations. However CMAL is satisfied that the framework has been awarded competitively using The Public Contracts (Scotland) Regulations 2015, using a process that is very similar to and as equally robust as that in The Utilities Contracts (Scotland) Regulations 2016. Additionally, CMAL is satisfied that they are listed on the Contract Award Notice as being within the group of organisations that can use the framework and the scope of services required are within the scope of the framework.",
