The commencement date is flexible to allow for any necessary changes to be made to the pre-planned programme of Works.\r\n\u2022\tIt is anticipated that the Contractor will undertake and complete the Works in their entirety over the school\u0027s summer 2025 holiday period. However, if at any time prior to the commencement of the pre-planned Works the boiler at the school fails or it requires urgent repair or maintenance works and it would not be economically viable to undertake such repairs or maintenance to the boiler, the Employer reserves the right to issue an instruction to the Contractor under the Agreement amending the pre-planned time period for the completion of the Works and to urgently bring forward the boiler replacement works (as per Design Option A).\r\n\u2022\tIn its instruction, the Employer can require the Contractor to undertake and complete the boiler replacement at the school urgently in line with the Employer\u0027s Requirements (save as to delivery period). The Contractor shall not be permitted to amend the Contract Sum if the schedule of Works is amended to prioritise the boiler replacement element of the Works. The boiler replacement Works shall be carried out within the timescales reasonably calculated and specified by the Employer in the instruction. Where relevant, the payment schedule for the boiler replacement element of the Works to allow for payment to be made in line with the new delivery timescales. The amended payment schedule for the boiler replacement works will be as detailed in the instruction.\r\n\u2022\tIf the boiler replacement works are conducted outside of the anticipated delivery period, the boiler replacement works must still be carried out in line with the Employer\u0027s instruction and the terms and conditions of the Agreement. All remaining elements of the Works forming the Employer\u0027s Requirements will be conducted in the originally pre-planned timescales unless other arrangements are confirmed under an instruction.\r\n\r\nEach Lot is an independent Lot.",
