"procurementMethodRationale": "The Authority, proposes to enter into a contract with Smiths\nDetection Limited (\u201cSmiths\u201d) on a single source basis in accordance\nwith paragraph 5 of Schedule 7 to the Procurement Act 2023 for the\nprovision of two Air Terminal Passenger \u0026 Baggage Handling Security\nScanner (the \u201cScanners\u201d). \nThis procurement will be governed by the Procurement Act 2023 (\u201cPA\n2023\u201d) Chapter 3, Section 41: Direct Award in Special Cases. It is\nconsidered that direct award of the proposed contract is lawful in\naccordance with PA 2023 Schedule 5 paragraph 7 which relates to the\nsupply of goods, services or works by the existing supplier when a\nchange in supplier would result in the Authority receiving goods that\nare different from, or incompatible with, existing goods, and the\ndifference or incompatibility would result in disproportionate technical\ndifficulties in operation or maintenance. \nIt is considered that direct award is lawful in accordance with\nparagraph 7 of Schedule 5 PA 2023 as the Scanners are the same as\nthe existing scanners in operation and no other supplier can provide a\nreplica of the existing scanners in both the security area and baggage\nhall, at Brize Norton. \nThe Scanners are required to be the same as the existing scanners in\noperation, as operating two (or more) different scanners, would cause\ndisproportionate technical difficulties in the operation and\nmaintenance of both the existing scanners and the new Scanners. In\nparticular, it would cause operational user risks to arise.\nFurther, by purchasing these Scanners from Smiths, training and\nmaintenance will be covered by an existing contract between the\nAuthority and Smiths. No other supplier will be able to offer this\nwithout disproportionate technical difficulties in operation and\nmaintenance. \nIn addition, the Authority requires continuity across equipment to\nensure interoperability and continuity for training and maintenance,\ntherefore Smiths is the only supplier able to provide the Scanners and\nthe ongoing maintenance and training required.",
