  "description": "The Council consider this opportunity to be procured under the Light Touch Regime of Public Contracts (Scotland) Regulations 2015.\nAs this is a Health and Social Care type contract, the Council were permitted to enter into negotiations with the Cyrenians under the Procurement Reform (Scotland) Act 2014 (\u201cthe Act\u201d), which states that Public Sector Organisations may award without seeking offers, considering the principles of procurement where relevant.\nIn this instance, as there was no suitable supply market other than the incumbent provider and this contract falls within the category of contracts covered by Regulation 74 of the Public Contracts (Scotland) Regulations 2015 and is being awarded in accordance with the process set out in Regulation 33, in particular Regulation 33 (1) section (b) where the works, supplied or services can be supplied only by a particular economic operator for any of the following reasons \u2013 (ii) competition is absent for technical reasons; there is a limited supply market.\nIt is a mandatory requirement of this Contract that a prompt payment clause is present, which ensures payment of sub-contractors at all stages of the supply chain within 30 days and includes an obligation to provide a point of contact for sub-contractors to refer to in the case of payment difficulties.\nIt is a mandatory requirement that organisations pay staff who work on the council framework pay at least the real Living Wage.\n(SC Ref:795015)",
